Acceptance of the Terms and Conditions also implies acceptance of the Privacy Policy. Before using the online store's service, the Customers should familiarize themselves with the Privacy Policy. 1.3. The personal data of the Service Recipient and Customer are processed in accordance with the provisions of the Act of May 10, 2018, on the Protection of Personal Data, Regulation (EU) 2016\/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95\/46\/EC (General Data Protection Regulation), hereinafter referred to as GDPR, as well as the Act of July 18, 2002, on the provision of electronic services.<\/p>\n\n\n\n

1.4. The Controller shall exercise special diligence in protecting the interests of individuals whose data is concerned, particularly ensuring that the data collected is processed in accordance with the law, collected for specific, lawful purposes and not subjected to further processing inconsistent with those purposes, accurate and relevant in relation to the purposes for which they are processed, and stored in a form that enables the identification of individuals to whom they relate for no longer than is necessary to achieve the purpose of processing.<\/p>\n\n\n\n

2. PURPOSE AND SCOPE OF DATA COLLECTION AND DATA RECIPIENTS<\/strong><\/p>\n\n\n\n

2.1. The purpose, scope, and recipients of data processed by the Controller are determined on a case-by-case basis by the actions taken by the Service Recipient or Customer in the Online Store. For example, if a Customer chooses personal pickup instead of courier delivery during the Order placement, their personal data will be processed for the purpose of concluding and executing the Sales Agreement but will not be provided to the carrier responsible for handling shipments on behalf of the Controller.<\/p>\n\n\n\n

a) conclusion and performance of the Sales Agreement or Electronic Service Agreement;
b) direct marketing of the Controller's own products or services;
c) offering products by the Controller;
d) development of the Controller's products and services (technological development, customization of services), enabling the tailoring of offers to match the Customer's preferences;
e) improving customer service by the Customer Service Department (BOK);
f) securing the Controller's claims and;
g) ensuring compliance with the legal requirements related to the conducted activities;<\/p>\n\n\n\n

2.3. Potential recipients of Customers' personal data:<\/p>\n\n\n\n

a) selected carrier or intermediary handling shipments on behalf of the Controller.
b) entity processing payments for Products purchased in the Online Store;
c) entities responsible for the maintenance and technical support of this Online Store website, as well as the entity monitoring the number of visitors to the website;
d) entities providing services to the Controller, such as accounting and debt collection services.<\/p>\n\n\n\n

2.4. The Controller may process the following personal data of Service Recipients or Customers using the Online Store: first and last name, email address, contact phone number, delivery address (street, house number, apartment number, postal code, city, country), residential\/business address (if different from the delivery address), Customer's dimensions, gender, information about the Customer's bank account, and transactional data. In the case of Service Recipients or Customers who are not consumers, the Controller may additionally process the company name and Tax Identification Number (NIP) of the Service Recipient or Customer.<\/p>\n\n\n\n

2.5. The provision of personal data as mentioned above may be necessary to conclude and perform the Sales Agreement or Electronic Service Agreement in the Online Store. The scope of data required to conclude the agreement is specified each time on the Online Store's website and in the Terms and Conditions..<\/p>\n\n\n\n

2.6. The retention period for Users' personal data is:<\/p>\n\n\n\n

a) in the event of User registration, for the duration of the User's account, i.e., until the account is deleted or for a period of 5 years from the User's last activity on the account
b) in the case of processing data for order fulfillment, for the period of tax liability expiration as stipulated by the applicable tax laws and the Act of September 29, 1994, on Accounting (Article 6(1)(c) of the GDPR)
c) in the case of processing data for the purpose of order fulfillment and settlement of services obtained in connection with the performance of agreements, for the period until the User raises an objection, with the reservation of the necessity of processing data until the end of the period required for the determination, pursuit, or defense of claims,
d) in the case of processing data for analytical purposes (i.e., for better tailoring services to User needs and optimizing service processes, including User profiling), as well as receiving promotional materials, including a commercial newsletter and providing the Newsletter service (Article 6(1)(a) of the GDPR), for a maximum period of 5 years, or for a shorter period in the event of the User withdrawing consent (in the absence of another legal basis for processing) or objecting (in which case data processing for this purpose will cease).

2.7. Personal data of Users may be disclosed to entities authorized to receive them under applicable laws, including relevant law enforcement authorities. 3. COOKIES AND OPERATIONAL DATA<\/strong><\/p>\n\n\n\n

  8. For remembering the closing of the informational popup about cookie files - 3650 days, after which the cookie is deleted.<\/li>\n\n\n\n
  9. For conducting anonymous statistics presenting the way of using the Online Store's website and researching the needs of Service Recipients, excluding personal identification of the Service Recipient - 365 days, after which the cookie is deleted.<\/li>\n<\/ol>\n\n\n\n

Providing personal data by the Service Recipient or Customer is voluntary, although the failure to provide the personal data indicated on the Online Store's website and in the Terms and Conditions, which are necessary for the conclusion and performance of the Sales Agreement or the Electronic Service Agreement, results in the inability to conclude such an agreement.<\/p>\n\n\n\n

    4.2. The legal basis for processing the personal data of the Service Recipient or Customer is the necessity of performing the contract of which they are a party or taking actions at their request before its conclusion. In the case of processing data for direct marketing of the Controller's own products or services, the legal basis for such processing is either (1) the prior consent of the Service Recipient or Customer or (2) the fulfillment of legally justified purposes pursued by the Controller (in accordance with Article 23(4) of the Personal Data Protection Act, direct marketing of the Controller's own products or services is considered a legally justified purpose).<\/p>\n\n\n\n

    5. RIGHT TO CONTROL, ACCESS, AND CORRECT ONE'S DATA <\/strong><\/p>\n\n\n\n

    5.1. The Service Recipient or Customer has the right to access the content of their personal data and to correct them.<\/p>\n\n\n\n

    5.2. Every individual has the right to control the processing of their personal data contained in the Controller's dataset, especially the right to: request the completion, updating and correction of personal data; temporarily or permanently suspend their processing or delete them if they are incomplete, outdated, inaccurate, collected in violation of the law, or no longer necessary for the purpose for which they were collected.<\/p>\n\n\n\n

    5.3. If the Service Recipient or Customer gives their consent to the processing of data for the purpose of direct marketing of the Controller's own products or services, the consent can be withdrawn at any time.<\/p>\n\n\n\n

    5.4. In the event that the Controller intends to process or is processing the data of the Service Recipient or Customer for the purpose of direct marketing of the Controller's own products or services, the individual whose data is concerned is also entitled to (1) submit a written, reasoned request to cease the processing of their data due to their specific situation, or (2) raise an objection to the processing of their data.<\/p>\n\n\n\n

    5.5. In the event that the Controller intends to process or is processing the data of the Service Recipient or Customer for the purpose of direct marketing of the Controller's own products or services, the individual whose data is concerned is also entitled to (1) submit a written, reasoned request to cease the processing of their data due to their specific situation, or (2) raise an objection to the processing of their data.<\/p>\n\n\n\n

    6. PROFILING <\/strong><\/p>\n\n\n\n

    The personal data of the Customer will not be subject to profiling and automated decision-making.<\/p>\n\n\n\n
